Welcome to MerchantIQ, a product offered by Rhabdom Solutions Private Limited ("Company", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the MerchantIQ platform (the “Service” or “Platform”).

By accessing or using MerchantIQ, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.

1. Eligibility
MerchantIQ is intended for use by businesses and professionals. By using this Service, you confirm that you are at least 18 years old and authorized to act on behalf of the business you represent.

2. Services Provided

MerchantIQ is a Software-as-a-Service (SaaS) solution designed to provide AI-driven sales and customer support tools for eCommerce platforms. Key features include:

AI-powered shopping assistant
Smart product recommendations
Lead capture through chat
Automated customer support
Real-time customer analytics

The Service is available on a subscription basis with a 30-day free trial.

3. Account Registration

To access the Service, you must provide accurate and complete information during sign-up, including your store link and contact details. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Free Trial and Subscriptions

We offer a 30-day free trial to new users. At the end of the trial period, you will be automatically charged based on the pricing plan selected unless you cancel your subscription before the trial ends.

All payments are non-refundable. You may cancel your subscription at any time, but no refunds will be provided for partial months or unused services.

5. Data Collection and Privacy

By using MerchantIQ, you consent to the collection and use of your data as described in our Privacy Policy. We collect user data, including names, emails, phone numbers, and behavioral data through chat interactions, for the purpose of improving service delivery, analytics, and marketing.

We comply with applicable data protection laws, including the Digital Personal Data Protection Act (DPDP) in India.

6. Use of Third-Party Services

MerchantIQ integrates with third-party platforms such as Shopify, WooCommerce, and others to deliver services. You acknowledge and agree that we are not responsible for the behavior, functionality, or availability of any third-party services.

7. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purposes
Interfere with or disrupt the integrity or performance of the Service
Attempt to gain unauthorized access to the Service or related systems
Use the Service to collect or transmit harmful or misleading content

8. Intellectual Property

All content, software, trademarks, logos, and technology used in or associated with MerchantIQ are owned by or licensed to Rhabdom Solutions Private Limited. You are granted a limited, non-exclusive, non-transferable right to use the Service as per these Terms.

9. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice. We may also update these Terms periodically. Continued use of the Service after changes indicates your acceptance of the revised Terms.

10. Limitation of Liability

To the maximum extent permitted by law, Rhabdom Solutions shall not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
